Ministry will challenge decisions affecting sustainability of Anchovies

The Ministry of Production (Produce) regretted that a Joint Judge Sechura in Piura Province has issued an injunction arbitrary attempt to deny that it has exclusive jurisdiction regarding such portfolio Fisheries Management.

With this injunction is authorized, without any scientific evidence, that 124 fishing boats called "Viking" enter extracting Anchovies from five miles and not from ten miles from the coastline, as has been done.

"With this measure, which relies not on any evidence scientifically, would put at risk the sustainability of the anchovy resource, the preservation of the marine ecosystem, which in turn jeopardizes the popular power to allow overfishing of anchovy, which is the main food of many marine species, "said Carmen Abregú, Director of Indirect Human Consumption of the Ministry of Production.

"The court has given it this undue and surprising injunction in open violation of the provisions of Art. 9 The General Fisheries Act, which requires scientific evidence to take action related to Fisheries Management" he said.

The lawsuit was filed within a process of protection by the Interdepartmental Committee on the Fishing Sector Defense Bay Sechuran, alleging violation of the right to free enterprise and freedom of work.
The lawsuit was filed before Judge Pedro Manuel Castro Chayguaque and looking to the main rule of fisheries management, the DS 011-2013-PRODUCE, be declared unconstitutional.

The official said the Ministry of Production in the immediate raise all protective measures necessary to prevent the impairment of the resource and announced it will be reported to the respective court for alleged malfeasance.

Produce said it respects the decisions of the judiciary and thereby raise the appropriate resources and, in turn, continue to monitor and the necessary measures within its legal and constitutional responsibilities will be taught.

"We must ensure that public interests are affected and which are detrimental to the population," he said Abregú.
"It is striking that the claim was filed in a distant court Sechuran and pretend that the decision applies nationwide," noted the official.
