The judiciary again to agree to Produce in regulation Fishing Industry

The judiciary came to agree with the Ministry of Production (Produce) in the regulation of industrial and artisanal fisheries, especially anchovy species.

The 6th. Civil Court of Lima declared completely legal and constitutional DS No. 08-2012 which prohibits Young Anchovy Fishery, to be held that class action suits filed by the National Fisheries Society. This rule requires fishing vessels to suspend operations in any area, if you look young or capturing less than allowed anchovy size. Produce develop a protection program Anchovy, after its population was found to be significantly decreased.

However, the National Fisheries Society (SNP) went to the judiciary to challenge the norm, using a Popular Action, considering that the aforementioned Supreme Decree did not specify in what area should be suspended fishing activities, which affected, they said, the right to freedom of enterprise.

But, when evaluating the issue, judges Oyague Emilia Bustamante, Manuel Miranda Alcantara and Juana Nunez Torreblanca found that although the standard does not delimited the area, provided that the Produce should issue a resolution that will regulate its implementation.

According to the Civil Court, until today no fishing company was fined Young Anchovy Fishery. The S.D. establishes a fine of up to 20 ITU vessels fishing this species, considered vital to maintain the Marine Ecosystem.
